OUR INSURANCE AND LIABILITY LIMITS

Protection against loss or liability is a vital consideration in the selection of a staffing service. As a client of Catalyst Healthcare Personnel, you have the advantage of being protected by one of the cost comprehensive packages of terms and conditions today.

• Catalyst Healthcare Personnel guarantees that our employees will satisfactorily perform the duties you request. Upon reasonable notice from you, all charges for unsatisfactory work will be cancelled and a replacement furnished as soon as possible which shall be your sole and exclusive remedy.

• Catalyst Healthcare Personnel will furnish staffing assistance requested by you in return for your payment to us at agreed-upon rates when due. Our employees will perform services under your direction, supervision and control. We assume legal obligation for our employees’ wages, benefits, payroll deductions, unemployment compensation, worker’s compensation and employer-shared social security.

• Catalyst Healthcare Personnel will maintain worker’s compensation insurance, professional liability insurance, general liability insurance and employee dishonesty bond subject to the following: 1) you will provide Catalyst Healthcare Personnel employees with a suitable workplace in compliance with all applicable safety and health standards, statutes and ordinances, all necessary information, training and safety equipment with respect to hazardous substances and adequate instructions, assistance, supervision and time to perform the services you request of them; 2) you are responsible for the acts, errors or omissions of Catalyst Healthcare Personnel employees who are performing clinical, clerical, support and professional services, who are working in situations lacking appropriate internal controls and safeguards.

• Catalyst Healthcare Personnel will indemnify you against any claims and expenses (including reasonable attorney fees and other costs and expenses of litigation) for bodily injury or property damage asserted by your employees, by our employees or by members of the general public which are based on any negligent act, error or omission by us, our agents or our employees within the scope of their assignment except as provided above. Our liability is restricted to the acts, occurrences and events covered by the terms of, and will not exceed the limits of, our insurance as summarized in our Certificate of Insurance and as follows: 1) you agree to notify us in writing of any asserted claim within ten days after either discovery of the occurrence upon which the claim may be based or learning of such claim, whichever occurs first, and to permit us to defend such claim at our option; 2) you agree not to pay any asserted claim without prior written approval from us.

• Except for usual worker’s compensation claims of our employees, you are responsible for all claims, losses, expenses and damages including bodily injury and property damage concerning the use of or loss of or damage to any vehicle and its contents, machinery, equipment or material in our care, custody or control and those of our agents and employees. By accepting the services of Catalyst Healthcare Personnel employees, you agree to the terms and conditions set forth on these pages.
